Coffee Break Briefing: Rent arbitrations; what's that all about?

There’s new legislation going through Parliament.  It’s going to become law, effective from 25 March 2022, as the Commercial Rent (Coronavirus) Act 2022.

When it does, it will in effect, phase out the temporary protection from eviction that business tenants have.  For now, landlords can’t forfeit business tenancies, or send in the bailiffs.  That ends on 25 March.

But landlords won’t be able to take action immediately.  First, they and their tenant will have to negotiate, in good faith, to seek agreement about allowing their tenant time to pay, or even writing off some of the arrears.  The new law sets up a statutory rent arbitration process for that.

I’ll be talking about the new law – and the opportunities I think it might offer to insolvency practices.
