Injury Claims - Your right to choose a lawyer

An injury can have a massive impact on the person affected, often with unforeseen and unexpected complications in the future. If you have suffered an injury that was not your fault and want to pursue legal action you should obtain advice from a solicitor specialising in injury claims.

Your insurance company may recommend a solicitor. You do not have to accept this lawyer – you have a perfect right to choose your own.

Injury Claims Solicitor, Imogen McMillan says "Choosing a lawyer should be done as soon as possible after your accident, as there are strict time limits on taking legal action. Most claims for  injury are as a result of negligence by a third party and the time limit for this is three years from you being aware of injury to issuing court proceedings. It will almost always be too late after this limitation period."

You will need to prove that your injury was caused by the negligence of another party, for example, an accident at work, a traffic accident or a local council. Once you have sought legal advice, our injury claims team will help you to gather evidence for your case.

It is advisable to report your accident as soon as possible to the appropriate authority, such as the police, your employer or local council, and also to take names and addresses of any witnesses. Photographs of any hazard that caused injury are also very useful. 

Compensation is awarded according to the seriousness of the injury and for any financial loss involved. Pain and suffering and the inability to do things after your accident that you could do before, are also taken into account, as well as how you may be affected in the future.

There are several special compensation schemes for some injuries and illnesses, particularly if you have been exposed to a harmful substance in the workplace such as asbestos. Also for people who contracted HIV whilst being treated for haemophilia and for damage caused by vaccination.
