News - Employment Tribunal fees

The saga of employment tribunal fees, introduced in July 2013, has continued recently with Jenny Willott MP, minister for employment relations and consumer affairs saying the level of tribunal fees is being kept under review by the government. She added that the regime is going to be subject to “a lot of parliamentary scrutiny”. This comes on top of new statistics showing there has been a 79% drop in employment tribunal claims since the fees were introduced and Unison announcing they are now seeking the Court of Appeal’s permission to appeal the High Court’s decision refusing their judicial review application over tribunal fees.

Comment

Many commentators are saying Jenny Willott’s comments are proof that the government has been shocked by the large reduction in claims to employment tribunals and the resulting accusation that the fees are a real bar to justice for ordinary people. Employment Associate Paul Burton says “It is our opinion that the tribunal fee system is here to stay, but there is a real chance the government will lower the fees in the not so distant future to a more realistic level.”
