Important Changes to the Law Enduring Powers of Attorney

From October 1st 2007 there was a change in the law which has considerably complicated how your affairs would be handled if you were to become mentally or physically incapable of dealing with your own affairs.

Prior to this, it was possible for you to sign a simple document called an Enduring Power of Attorney (EPA), and the new document is called a Lasting Power of Attorney (LPA). The documents are both prepared to ensure that a trusted person is appointed to act on your behalf if incapacity were to strike.

The New Law

In October 2007, the EPA was superseded by the more complex Lasting Power of Attorney (LPA). As well as covering financial affairs, the LPA can cover health and welfare issues. Every LPA needs to be registered with the Court as soon as it needs to be used.
