Join the Frettens Employment Team for a morning seminar focussing on the potentially fair reasons for dismissal

With the prospect of day one unfair dismissal rights on the horizon, we will be looking at what you need to establish to justify a fair dismissal even under the current regime.

With reference to worked examples, statue and case law, we will focus on:

  • What is a dismissal and when does it take effect?
  • The potentially fair reasons for dismissal and how they are established in law
  • Quirky issues around dismissal including:
    • The overlap of conduct dismissals with criminal or regulatory matters
    • Automatic unfair dismissals
    • Conduct v capability: which is it?
    • Conduct outside of work and justifying disciplinary action

The session will focus on exactly what it is that employers may have to show if legal proceedings for unfair dismissal follow a decision to terminate employment. 

In addition, as the Employment Rights Bill progresses through Parliament and looks likely to receive Royal Assent this summer, the team will now also provide an update on key changes from the first draft, and those provisions which may even come into force later this year.

This will be a great opportunity to learn or refresh the reasons behind the procedures as well as ask questions to the team about the law which underpins your processes.
